Steamboat Springs — A jury this week found a Clark man not guilty of six of the seven charges that had been filed against him, including a felony charge of menacing.

“The jury disagreed with the three accusers,” said Larry Combs, who was representing Brad Nickum.

Nickum turned himself in April 20 to the Routt County Sheriff’s Office for an incident that occurred Oct. 23 near Steamboat Lake. The Routt County District Attorney’s Office charged Nickum with a single felony, menacing, reckless driving, reckless endangerment, three charges of harassment and third-degree criminal trespassing. The jury found Nickum guilty of one of the harassment charges at the conclusion of the three-day trial.

Combs said the October incident was essentially a feud between neighbors and started when Nickum confronted three women on horseback who he thought were trespassing on his property.

“He’s had problems with trespassers before,” Combs said.

Combs said the women rode away, and Nickum was in his car when he found them again along Routt County Road 129. Combs said the women rode off, and Nickum met up with them again on another road. Combs said the situation escalated when one of the woman accused Nickum of trespassing.

The three women said Nickum then put his truck in reverse and started driving after one of the women, who told deputies she felt Nickum was threatening her. The menacing charge stated Nickum used his car to put Susan Ostrowski in fear of imminent serious bodily injury.

Combs said Nickum admitted to calling one of the women offensive names, which led to the jury finding him guilty of harassment. He was ordered to pay $276.50 in fees and fines.
